Terms & Conditions
These terms apply to businesses and their authorised users who use the TummyMumma service. Please read them carefully.
1. The service
TummyMumma is a software product operated by ARK STUDIO, a proprietorship of Kaustubh Amar Shinde. In these terms, “TummyMumma”, “we” and “us” mean ARK STUDIO, a proprietorship of Kaustubh Amar Shinde (GSTIN 27CHGPS8333B1Z9), with its principal place of business at FL 7, H NO 410, Parijat Housing Society, Shaniwar Peth, Opp. Natu Bag Wada, Pune, Maharashtra 411030, India.
TummyMumma provides online business-management software for independent food businesses, including product catalogues, digital menus, order management, customer records, payment tracking, receipts, posters and related tools (the “Service”). TummyMumma is currently offered as early access, and features may change.
TummyMumma is a software provider. We do not make, sell, supply or deliver the food, products or services that businesses sell to their customers, and we are not a party to those sales.
2. Eligibility and accounts
- You must be at least 18 years old and able to enter into a binding agreement, and you must use the Service for a genuine business.
- You are responsible for your account, for keeping your password and two-step verification secure, and for everything done through your account, including by staff you invite.
- Provide accurate information and keep it up to date. Tell us promptly at admin@tummymumma.com if you suspect unauthorised access.
3. Acceptable use
You agree not to:
- use the Service for anything unlawful, fraudulent or misleading, or to sell prohibited or unsafe goods;
- send spam or unsolicited messages, or collect people’s data without a lawful basis;
- attempt to access other businesses’ data, probe or bypass security, or disrupt the Service;
- copy, resell or reverse-engineer the Service except as the law allows;
- upload content that infringes others’ rights or is harmful or offensive.
4. Your data and your customers
- You keep ownership of the business content and data you put into TummyMumma. You give us permission to host and process it only to provide and improve the Service and as described in our Privacy Policy.
- You are responsible for your dealings with your customers, including collecting and using their information lawfully, your prices, food safety, licences, taxes, and your own cancellation, refund and delivery terms.
5. Subscription and service charges
Any fee you pay to TummyMumma is for the software Service only. During early access, we will tell you about any plan, its price and its terms before you are asked to pay. Cancellation and refunds of TummyMumma charges are covered by our Refund & Cancellation Policy.
6. Your customers’ payments
Money your customers pay for your products or services belongs to your business and is not TummyMumma’s revenue. With direct UPI, customers pay your own UPI ID directly. TummyMumma helps you record and track these payments; it does not hold your money and is not a bank, wallet, escrow or payment service.
7. Third-party services and payment providers
Some features may use third-party services, such as regulated payment providers or messaging platforms. Their use may be subject to the provider’s availability, its own terms and eligibility checks (including know-your-customer requirements) and applicable law. TummyMumma does not control third-party services and is not responsible for them. Mention of a third-party service does not mean it is available to every business.
8. Intellectual property
The Service, its software, design and the TummyMumma name and logo belong to ARK STUDIO or its licensors. These terms give you a limited, non-exclusive, non-transferable right to use the Service for your business while your account is active.
9. Availability and changes
We work to keep the Service available and reliable, but it may sometimes be unavailable because of maintenance, updates or events beyond our control. During early access we may add, change or remove features. We will try to give reasonable notice of significant changes.
10. Responsibility and limitation
The Service is provided on an “as available” basis. To the extent permitted by law, TummyMumma is not liable for indirect or consequential losses, lost profits or lost data, or for the acts of your customers or of third-party services. Nothing in these terms limits any liability that cannot be limited under applicable law. You are responsible for keeping your own copies of important business records.
11. Suspension and termination
You may stop using the Service at any time. We may suspend or end access if these terms are seriously or repeatedly breached, if needed to protect users or the Service, or if required by law. Where possible, we will give notice and a chance to export your data.
12. Changes to these terms
We may update these terms. We will update the “Last updated” date and, for significant changes, notify businesses using the Service. Continuing to use the Service after changes take effect means you accept the updated terms.
13. Governing law
These terms are governed by the laws of India.
